Privacy is an important personality right owned by a person as an individual to ensure his life security and independence; therefore, it is a highly individualized right. But due to the convenience of living together among family members and families characterized by “collectiveness”, the possibilities of breaching privacy increase greatly, which haven’t drawn much deserved attention. From the perspective of privacy conflict, by using comparative law to analyze specularities of the privacy conflict between parents and their offspring, and between spouse, and by making empirical analysis on the existing case references in China, the paper finally proposes prior judging rules for privacy conflict.
