On the Place of Historical System in Criminality and Malpractice of the Principle of Reliance—On the Basis of the Evolution of Criminality in Germanic and Japanese Criminal Law
Abstract：The principle of reliance has a deep legal basis and a good foundation on humanism. The author makes a concrete analysis on changes of the criminal law system on the basis of the principle of reliance and of the place of system of criminality. In addition, the principle of reliance can influence the care obligations to limit liability for malpractice. The principle of reliance is a kind of cause for Tatbestandsmβigkeit, which focus on taking reasonable measures to avoid dangers.
