Abstract: Compared with traditional industries, super platforms have advantages in terms of data quality and quantity, and it is easy to use their data advantages to gain consumers' attention and form competitive advantages. On the one hand, data helps platforms to continuously adjust their business strategies and form new modes, new industries and new business forms; on the other hand, once a super-platform abuses its dominant position by using its data advantage, it is easy to form a dominant position in the market, raise the barriers to market entry, and undermine the order of competition in the market. In order to differentiate between abuse of market dominance and normal business behavior, the relevant system of the “Anti-monopoly Law” should be improved. The considerations of market definition, determination and presumption of dominant market position should be refined. And factors such as privacy and innovation should be incorporated into the analytical framework so as to prudently measure the competitive effects of the behavior. In conclusion, the regulation of the abuse of market dominance by super platforms using data advantage should be strengthened to help the development of small and medium-sized platform enterprises and release the innovation momentum of the platform economy.
