Co-establishment and Co-location of Party and Government: Historical Evolution, Contemporary Value and Realization Path——A Perspective Based on Optimality Consideration

Abstract:The co-establishment and co-location of the Party and government is an important part of the reform of the Party and government institutions in China. It is also a kind of institutional arrangement with Chinese characteristics. From a practical perspective, in the historical context of its development and evolution, it contains the optimality consideration for pursuing efficiency. However, from the theoretical perspective, the traditional theory of the administrative law is not enough to explain the practice of co-establishment and co-location of the Party and government. Therefore, the optimality consideration is also necessary from the theoretical perspective. There is distinct contemporary value in the optimality consideration of the practice of co-establishment and co-location of the Party and government, which is helpful to upholding the leadership of the Party, and helpful to promoting the optimal settings of administrative organizations, helpful to carrying out the will of the Party, helpful to ensuring the best performance of administrative tasks, helpful to implementing the Party’s purpose and helpful to realizing the optimal construction of the administrative legal system. In response to the practice of co-establishment and co-location of the Party and government, it is necessary for the administrative law to take consideration of optimality and to uphold China’s position, both of which should be carried out in the theoretical innovation and system improvement for the promotion of further reform.
