Abstract:The Criminal Procedure Law of China, revised in 2012, added the provision of “beyond reasonable doubt”as a description of “the clear facts and clear and sufficient evidence” in the standard of proof provision. This article studies the concept of“beyond reasonable doubt”in the Anglo-American criminal justice, discusses the necessities of adopting it in China’s criminal procedural law, exploring the circumstances of using this stadard in trial, and explains the relation between “beyond reasonable doubt” and the other relevant provisions, inter alia, the requirements of proof in activities of investigation and prosecution. The author points out that there should be the different levels of proof standards in different stages of the criminal process. Finally, the author explains the questions concerning “beyond reasonable doubt”in China’s judicial practice.
