Abstract:The criminal prosecution should begin from placing a case on file for investigations to the prosecution, the first trial, the second trial continuously, and to the execution. However, there are many reverse procedures in our criminal prosecution. Some procedure reverses are necessary and reasonable, but most of them deviate from the goal of Law of Criminal Procedure or conflict with the basic principles of Law of Criminal Procedure, or even violate criminal prosecution's basic ideas. To improve the related legal procedure and the system, it is necessary to make the revision to the relevant law and the judicial interpretation: retaining the necessary and reasonable procedure reverses; abolishing the unnecessary and the unreasonable procedure reverses; limiting necessary but less scientific procedure reverses.
