Abstract:The principle of good faith of litigation law is the fundamental support of the social value of good faith, and restrains the adversary system. Litigious fraud cheats and endangers judicial systems which safeguard the social value of good faith. It should be regulated alone for its special social harm. In order to regulate litigious fraud, triple legal norms, including litigation, tort, and criminal, must be constructed.
