Abstract:There is a general rule that a state can invoke immunity with regard to proceedings relating to the state-owned vessels. The restrictive immunity doctrine considers that if the vessels were used for other than government non-commercial purposes, the state cannot invoke immunity. However, the state that only owns the vessels but doesn't operate it cannot be asked to take on the compensative responsibility of the vessels with any means.
